What Is A Business Lasting Power of Attorney?

• A legal document in which you nominate who will be able to make decisions about your business should you become unable to.

• It’s for business partnerships where there is no personal relationship between you – your business partner isn’t your spouse, for example.

• It allows your chosen Attorney to manage the business bank accounts and finances. You can also have reserves.

• Your attorney will be able to continue paying staff and invoices, and sending out invoices so your income doesn’t stop.

• If necessary, your Attorney could close down or sell the business – dealing with the finances, property and assets.

• Having a BLPA in place means if you become unable to run the business and make decisions, the company can continue to run.

What If You Don’t Have A Business Lasting Power of Attorney?

• If you lose mental capacity, or the ability to make decisions, the business will grind to a halt.

• No one, not even a business partner, will be able to access joint bank accounts. The bank sees both of you as 100% owners. With you incapacitated, and no BLPA to stand in for you, they will freeze the accounts.

• Staff and contractors will not get paid.

• Invoices, rent, utilities won’t be paid.

• With no money coming in, and no one able to pay staff and invoices, the business will come to a stop.

• Without going through a lengthy and expensive court process, no one will be able to take control of the business or sell it.
